Painted Pinkies (paintedpinkies.com) respects the intellectual property rights of others and expects its readers and contributors to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. 512), we respond promptly to clear notices of alleged copyright infringement on this website.

Our Content

The articles, text, and images on Painted Pinkies are created for this website. If you believe that any content on paintedpinkies.com infringes your copyright, please send us a notice using the process below and we will act on it quickly. You do not need a lawyer to file a notice.

How to Send a Takedown Notice

Email your notice to contact@paintedpinkies.com with the subject line “DMCA Takedown Notice”. To be effective under the DMCA, your notice must include:

  • Your full name and, if applicable, the name of the copyright owner you represent
  • A description of the copyrighted work you believe has been infringed
  • The exact URL (or URLs) on paintedpinkies.com where the material you are reporting appears
  • Your contact information, including an email address and a phone number or mailing address
  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner’s behalf
  • Your physical or electronic signature

What Happens Next

When we receive a complete and valid notice, we will review it and remove or disable access to the reported material as quickly as we reasonably can. Where appropriate, we will notify the person who provided the content so they have a chance to respond.

Counter-Notification

If your content was removed because of a takedown notice and you believe the removal was a mistake (for example, you own the rights, have permission, or the use qualifies as fair use), you may send a counter-notification to contact@paintedpinkies.com with the subject line “DMCA Counter-Notification”. Your counter-notification must include your name and contact information, the URL of the removed material, a statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification, a statement consenting to the jurisdiction of the federal district court for your address (or, if you are outside the United States, for any district in which we may be found), that you will accept service of process from the person who sent the original notice, and your physical or electronic signature. If we receive a valid counter-notification, we may restore the material 10 to 14 business days later unless the original notifier informs us they have filed a court action.

Repeat Infringers

It is our policy, in appropriate circumstances, to remove content and, where we control accounts or submissions, to terminate repeat infringers.

A Note on Fair Use

Before sending a notice, please consider whether the use may be permitted under fair use (such as commentary, criticism, or educational use). Knowingly sending a materially false takedown notice can carry legal consequences under the DMCA.
